Terms of service
The agreement between Orbis IQ and a company that uses Orbis Field. Individual employees use the app under their company's account, not under these terms directly.
Who these terms bind
These terms are between Orbis IQ, the provider of Orbis Field, and the company that licenses it. A company accepts them by asking for an account. Employees use the software under their company's account; their relationship is with their employer.
What the service is
Orbis Field is software for planning, recording and reporting field work: visits, orders, samples, targets, routes, collections, expenses and the reports built on them. It is a record-keeping and analysis tool. It does not give medical, legal, tax or financial advice, and decisions taken on its reports are the company's own.
The account and the administrator
Each company names an administrator. The administrator creates and removes logins, assigns roles, and is the person we deal with. The company is responsible for who holds a login, for keeping passwords private, and for what its people record.
Acceptable use
The company agrees that its people will not:
- try to reach another company's workspace, data or files;
- copy, resell, reverse-engineer or interfere with the software;
- record anything unlawful, or record information about a person without a lawful basis to do so;
- use a fake-location app or a modified device to falsify a visit.
The company's data
Everything a company and its people record stays the company's. We process it only to run the service, as described in the privacy notice. The company warrants that it has a lawful basis for the information it records about third parties, such as doctors and pharmacies, and that it has told its employees what the app records.
The company can export its data at any time using the reports and exports inside the product.
Availability
We work to keep the service available at all times and to announce maintenance in advance. We do not promise uninterrupted availability unless a separate written agreement says so. The phone app keeps working without a connection for the field work it is designed for and uploads when a connection returns.
The free 30-day trial
A trial gives a company the full product for thirty days with no payment details taken. At the end of the trial the company chooses whether to continue. If it does not, the account is closed and its data is deleted after a grace period during which it can be exported on request.
Fees
Fees are agreed with each company in writing. Nothing is charged through this website or through the app, and neither offers anything for purchase.
Suspension and ending the agreement
Either side can end the agreement with written notice. We can suspend an account that breaks these terms, after telling the administrator why. When an agreement ends, the company's data is kept for a stated grace period so it can be exported, and is then deleted.
Liability
We are liable for our own failures up to the fees the company has paid for the service. We are not liable for commercial decisions taken on the reports, for data the company's people recorded incorrectly, or for loss caused by a handset, network or third-party service outside our control. Nothing in these terms limits liability that the law does not allow to be limited.
Changes to the service and to these terms
The product changes regularly, and these terms change occasionally. A change to these terms is announced to each company's administrator with its effective date. Continuing to use the service after that date accepts the change.
Governing law
These terms are governed by the law of the Republic of Iraq, and disputes are settled in its courts, unless a separate written agreement with the company says otherwise.
